The Södertörn District Court in Eastern Sweden has ruled it OK to masturbate in public after it acquitted a 65-year old man for giving himself a sandy handy at a beach in Stockholm over the summer.

Sweden’s English language news website The Local reported that the court said no offense had been committed as the masturbating man was not pleasuring himself toward a specific person.

Public prosecutor Olof Vrethammar said he wouldn’t appeal the decision.

“For this to be a criminal offence it’s required that the sexual molestation was directed towards one or more people. I think the court’s judgement is reasonable,” he said, according to The Local.

“The district court has made a judgement on this case,” he added. “With that we can conclude that it is OK to masturbate on the beach. The act may be considered to be disorderly conduct.”

Dr. Liz Davies of London Metropolitan University, who has researched Sweden’s child protection system said the decision surprised her.

“Sweden has a really robust child protection system and very rigorous investigation around sexual abuse,” she said. “So this judgement is surprising given that such an act could be witnessed by children as well as adults.”

  1. i was actually just having a conversation with a (male) friend of mine about masturbation. he was asking if i would be bothered if i saw a man doing it in public, even if he wasn’t looking at me and it wasn’t directed, like, at me or anything. it made me think about if it would bother me and why. i think that i (probably most people) want to be able to navigate through my daily life with as little unsolicited sexual exposure as possible. not too much to ask. friends point was then that a man would be super turned on to see a woman pleasuring herself and it would be the greatest thing to stumble upon ever. ok. but (mostly) there is no shortage of male sexuality available at any given time (comments. stares, sexualized advertisements everywhere etc.) whereas unsolicited female sexuality is (mostly) not as readily available. supply and demand (ish?) – maybe.

    in sweden’s case – how can you not argue that masturbation is a sexual act and sexual acts are not to be performed in public? or is public sex ok in sweden too? this bothers me. i would like to see what would have happened if it were a woman doing the same thing….

  2. Yes, and actually a very close friend of mine was “visually molested” so to speak once where we grew up at Juno beach. She was down by the water and looked up toward the dunes and saw a man pleasuring himself while he was staring at her. She took the correct measures afterward but it bothered her for a very long time, as it would anyone I think. Nude beaches are one thing. Marsinski beach is actually, legally, a nude beach. But there are very specific precautions in order for something like that to be deemed safe.
